Terms & Conditions

These Terms & Conditions govern your use of https://lumarnicurtains.com/ (the Website) and any quotation, order or purchase made from Lumarni Curtains ABN 65 357 887 789 (Lumarni, we, us or our).

By using the Website, accepting a quotation or placing an order, you agree to these Terms & Conditions. If you do not agree, please do not use the Website or place an order.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

1. About Lumarni

Lumarni supplies made-to-measure curtains and related items to customers in Australia. Unless a product page, quotation or order confirmation expressly states otherwise:

  • our curtains are manufactured to the measurements and specifications confirmed in your order;
  • curtain tracks, curtain rods and installation services are not included; and
  • you are responsible for arranging a suitable track or rod and, where required, a suitably qualified installer.

2. Eligibility and authority

You must be at least 18 years old and legally capable of entering into a contract to place an order. If you place an order for another person, business or property owner, you confirm that you have authority to do so and to provide the relevant measurements and specifications.

3. Product information and fabric samples

We take reasonable care to describe and display our products accurately. Images are illustrative, and the appearance of fabric may vary because of screen settings, indoor and outdoor lighting, surrounding colours, weave, texture and production batch.

We recommend ordering and inspecting a physical fabric sample before purchasing made-to-measure curtains. A sample is a guide only. Minor variations in colour, texture, weave or finish may occur between a sample and the finished product, or between separate production batches. If matching curtains are required for the same room, we recommend ordering them together.

Product availability, specifications and pricing may change before we accept an order. Any change made after we accept an order will apply only if agreed with you or permitted by law.

4. Quotations and orders

A quotation is valid for the period stated on it. If no period is stated, it is valid for 14 days from its issue date, unless withdrawn earlier because of an obvious error or an event outside our reasonable control.

Your request or submitted order is an offer to purchase. A binding contract is formed when we send written confirmation that we have accepted the order and any required payment has been received or authorised. An automated acknowledgement of your request does not, by itself, mean that we have accepted it.

Your contract with us consists of these Terms & Conditions and the applicable product page, quotation and order confirmation. If they are inconsistent, the order confirmation prevails for the specific commercial details of that order, followed by the quotation, these Terms & Conditions and then the product page.

We may decline an order before acceptance, including where a product or fabric is unavailable, the specifications cannot reasonably be manufactured, the delivery address is outside our service area, payment is not authorised or there is an obvious pricing or description error. If we cannot accept an order after taking payment, we will refund the amount paid for the unaccepted order.

5. Your measurements and specifications

You must carefully check all details before confirming an order, including:

  • finished curtain width and drop;
  • the point from which each measurement was taken;
  • opening direction, number of panels and curtain fullness;
  • heading or hanging style;
  • fabric, colour and blockout selection;
  • whether one or two curtain layers are required;
  • track or rod compatibility and load capacity; and
  • clearance from handles, furniture, air conditioners, skirting boards and other obstructions.

Unless we have agreed in writing to provide an on-site measuring service, you are responsible for the accuracy and completeness of measurements supplied by you. Guidance based on photographs, diagrams or information supplied remotely is general assistance and is not a substitute for an on-site inspection.

If the curtains are made in accordance with your confirmed specifications but do not fit because the measurements or other information you supplied were incorrect, alteration or remanufacture may involve additional charges. We will tell you the available options and obtain your approval before undertaking chargeable work.

This section does not limit your rights where the problem was caused by our error, our failure to follow the confirmed specifications, misleading information supplied by us, or another failure to comply with a consumer guarantee.

6. Changes and cancellations

Contact us immediately if you need to correct or change an order. Because made-to-measure products are manufactured specifically for you, changes or cancellation may not be possible after fabric has been cut, materials have been specially ordered or production has started.

If we agree to a requested change or cancellation, we will explain any reasonable additional cost or non-recoverable amount before proceeding. Any charge will reflect costs reasonably incurred in connection with your order and will not affect rights you may have under the Australian Consumer Law.

We may cancel an accepted order if we cannot supply it because of discontinued or unavailable material, a safety issue or an event outside our reasonable control. If that happens, we will offer an appropriate alternative for your approval or refund the amount paid for the part we cannot supply.

7. Prices, GST and payment

Unless clearly stated otherwise, prices are in Australian dollars and include GST where GST applies. The total price, delivery charges, any card surcharge and the required payment schedule will be displayed at checkout or stated in your quotation or order confirmation before you commit to the order.

You must pay using an accepted payment method and by the due dates stated in the order documents. We do not have to begin production until the required payment has cleared.

If an obvious pricing error occurs, we will notify you as soon as reasonably practicable. Before accepting the order, we may correct the price or decline the order. If we discover the error after acceptance, we will not charge a higher price without your agreement; if no agreement is reached, we may cancel the affected item and provide a refund.

8. Production timeframes

Estimated production timeframes are provided on the relevant product page, quotation or order confirmation. They are estimates rather than guaranteed dates unless we expressly agree to a guaranteed date in writing.

Production may be affected by fabric availability, order quantity, curtain dimensions, selected heading, production capacity and events outside our reasonable control. We will notify you of a material delay when reasonably practicable and work with you on an appropriate solution. Your rights under the Australian Consumer Law, including any right relating to supply within an agreed or reasonable time, are not affected.

9. Delivery

Delivery availability, charges and estimates depend on the destination, order dimensions and contents. Additional arrangements or charges may apply to regional or remote locations, but these will be disclosed before the order is accepted.

Please provide a complete and accurate delivery address and ensure that the location can safely receive the parcel. Tell us promptly if the address needs to change. An address change may not be possible after dispatch and may result in a reasonable carrier redirection charge.

Orders may arrive in more than one package. Tracking details will be provided where the selected carrier offers tracking.

Risk of loss or damage remains with us until the order is delivered to the nominated delivery address or collected by you or your authorised representative. If a parcel is delayed, lost or damaged in transit, contact us so that we can investigate and provide any remedy required by law.

10. Inspection after delivery

Please inspect the product as soon as reasonably practicable after delivery. If you believe that an item is damaged, faulty, incomplete or different from the confirmed specifications, contact us promptly at info@lumarnicurtains.com and provide:

  • your name and order number;
  • a description of the issue;
  • clear photographs or video of the product, packaging and shipping label, where relevant; and
  • any other information reasonably needed to assess the issue.

Prompt notice helps us investigate carrier or production issues, but it does not remove or shorten any rights or timeframes that apply under the Australian Consumer Law.

11. Change-of-mind returns

We do not generally accept change-of-mind returns or cancellations for made-to-measure products because they are manufactured to your selected measurements, fabric, colour and style and may not be suitable for resale.

A change of mind includes deciding that you no longer want the product, choosing the wrong colour or style, or supplying incorrect measurements, where the product otherwise matches the confirmed order and complies with the law.

This change-of-mind policy does not apply where the product is faulty, unsafe, materially different from its description or confirmed specifications, not of acceptable quality, unfit for a disclosed purpose, or otherwise fails to comply with a consumer guarantee.

12. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, if a product or service fails to comply with a consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation of a service, compensation or another remedy.

The appropriate remedy depends on the nature of the problem and whether the failure is major or can be remedied within a reasonable time. We will assess claims consistently with the Australian Consumer Law and may ask to inspect the product or obtain reasonable supporting information.

Where we ask you to return a product and the claim is valid, we will bear reasonable return costs as required by law. Do not dispose of, alter, wash, cut or attempt to repair a product after discovering a possible fault unless reasonably necessary for safety or we have agreed to it, as doing so may affect our ability to assess the issue.

13. Installation, tracks and rods

Unless expressly included in your quotation or order confirmation, Lumarni does not supply or install curtain tracks or rods and does not provide installation services. You are responsible for ensuring that:

  • the track, rod, brackets, fixings, wall or ceiling structure and installation method are suitable for the curtains;
  • the installation area is safe and free from concealed electrical, plumbing or structural hazards; and
  • installation is carried out safely and, where appropriate, by a suitably qualified or experienced installer.

We are not responsible for damage caused solely by an unsuitable or incorrectly installed third-party track, rod, fixing or structure. This does not limit liability that cannot lawfully be excluded, including liability arising from our own goods, instructions, negligence or breach of a consumer guarantee.

14. Product performance and care

Any blockout percentage describes the light-blocking performance of the selected fabric, not guaranteed darkness of a room. Overall results depend on factors including curtain coverage, fullness, installation position, gaps at the top, sides, centre and bottom, window construction and surrounding light.

Sheer-curtain privacy varies with indoor and outdoor lighting, viewing angle, fabric colour and weave. Sheer curtains do not guarantee complete privacy under every condition, particularly at night when lights are on inside.

Statements about thermal comfort, UV filtering or noise reduction describe the intended characteristics of the relevant fabric or curtain. Actual performance depends on the room, windows, coverage, installation, climate and other conditions. Curtains are not a substitute for structural insulation, glazing, window sealing or architectural soundproofing.

You must follow the care instructions supplied with the product. Washing methods vary by fabric. Damage caused by care or use that is inconsistent with the supplied instructions may not constitute a product defect, although this does not affect any rights that apply by law.

Temporary packaging folds or creases may occur. Once correctly hung, a heat-set curtain may take up to 30 business days to relax and settle into its intended shape.

15. Website content and acceptable use

Website content is general information and does not replace an on-site assessment or professional building, installation or design advice. You may use the Website only for lawful purposes.

You must not knowingly:

  • interfere with the Website's operation or security;
  • introduce malicious code;
  • use automated means to extract substantial Website content without our written permission; or
  • use the Website or its content in a way that infringes another person's rights.

We may suspend access to protect the Website, other users or our legitimate interests, but will not exercise this right in a way that unlawfully affects an accepted order.

16. Intellectual property

Unless otherwise stated, the Website and its original text, photographs, graphics, designs, logos and other content are owned by or licensed to Lumarni and are protected by intellectual property laws.

You may view and print reasonable extracts for personal, non-commercial purchasing purposes. You must not reproduce, modify, publish, sell or commercially exploit our content without prior written permission, except where permitted by law.

17. Third-party services and links

The Website may use or link to third-party services such as payment processors, delivery providers or social media platforms. Their own terms and privacy practices may apply. We are not responsible for independent third-party websites that we do not control, but remain responsible for our obligations to you under applicable law.

18. Privacy

We handle personal information in accordance with our Privacy Policy. Please read that policy to understand how we collect, use, disclose and protect personal information.

19. Liability

To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

Nothing in these Terms & Conditions excludes, restricts or modifies:

  • the Australian Consumer Law or any other right or remedy that cannot lawfully be excluded, restricted or modified;
  • liability for fraud, wilful misconduct, personal injury or property damage caused by negligence; or
  • your right to recover reasonably foreseeable loss or damage resulting from a failure to comply with a consumer guarantee.

20. Events outside reasonable control

Neither party is responsible for delay caused by an event outside that party's reasonable control, to the extent the delay could not reasonably have been avoided or overcome. The affected party must take reasonable steps to minimise the impact and resume performance.

If such an event materially delays an order, we will communicate with you and offer an appropriate solution. This clause does not require you to pay for goods or services that we do not supply and does not limit rights that cannot lawfully be excluded.

21. Changes to these Terms & Conditions

We may update these Terms & Conditions by publishing a revised version on the Website. The version accepted when we accepted your order will continue to govern that order unless a change is required by law or you agree to it.

22. Governing law and disputes

These Terms & Conditions are governed by the applicable laws of Australia. Each party submits to the jurisdiction of the Australian courts and tribunals that are entitled to hear the relevant dispute.

If a dispute arises, please contact us first and provide reasonable details of the issue. We will try to resolve it promptly and fairly. Nothing in this section prevents either party from seeking urgent relief or using any court, tribunal, regulator or consumer-protection process available by law.

23. General

If part of these Terms & Conditions is found to be invalid or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining terms will continue to apply.

A delay in exercising a right does not waive that right. You may not transfer an accepted order without our written consent, which will not be unreasonably withheld. We may transfer our rights or obligations as part of a genuine business restructure or sale only where doing so does not reduce your rights or remedies.
